About this Case
Katz Banks Kumin LLP and The Legal Aid Society represent the plaintiffs, and were appointed Class Counsell, for a Settlement Class of all current and former personal assistants who were paid through Public Partnerships as the statewide fiscal intermediary for services performed as part of CDPAP in New York City, Nassau County, Suffolk County, and/or Westchester County (collectively, “downstate personal assistants”) at any time between March 1, 2025 and April 30, 2026.

7.1.2026 Update: Federal Court Grants Preliminary Approval of $162 Million Settlement for New York Home Care Workers
A federal judge granted preliminary approval of the proposed $162 million wage-and-hour class action settlement.
The settlement will benefit 200,000 personal assistants who were paid through Public Partnerships LLC (PPL), the statewide fiscal intermediary for New York’s Consumer Directed Personal Assistance Program (CDPAP), and provided services in New York City, Long Island, and Westchester County between March 1, 2025 and April 30, 2026.

New York Home Care Workers Represented by KBK and Legal Aid Society Settle Major Wage and Hour Class Action Matter
Plaintiffs Philip Calderon, Farshad Pinchasi, Allison Fields, and Dana Folgar, represented by Katz Banks Kumin LLP and The Legal Aid Society, announced that they have reached a proposed settlement with Public Partnerships LLC, and moved for preliminary court approval of the proposed settlement, in the class action lawsuit Calderon v. Public Partnerships LLC.
The proposed class action settlement, which is subject to court approval, will provide at least $162 million for a class of approximately 200,000 downstate personal assistants for Public Partnerships, LLC (PPL), the sole statewide fiscal intermediary for New York’s Consumer Directed Personal Assistance Program (CDPAP).

6.17.26 Update
The parties have reached an amicable settlement providing monetary and non-monetary relief, although we are not releasing further details at this time while preparing court papers that will be filed next week. The class, if approved by the Court, will cover personal assistants providing care under the CDPAP program in New York City, Long Island, and Westchester County.
Further, the Court has scheduled a preliminary approval hearing on July 1, 2026. If the Settlement is preliminarily approved and a class is certified, notice will be sent to class members. The settlement will not be final until after that notice period and final approval by the Court, which will require a number of months to complete.
