Carolyn Wheeler Speaks to Bloomberg Law About 5th Circuit Ruling
KBK partner Carolyn Wheeler spoke with Bloomberg Law about a recent Fifth Circuit ruling for the article, “Full 5th Cir. Expands Anti-Bias Rights in Weekend Work Case.”
On August 18, The US Court of Appeals for the Fifth Circuit issued an en banc opinion broadening the scope of employer actions that can trigger a workplace discrimination lawsuit. Previously, lawsuits could only be triggered by “ultimate employment decisions” related to hiring, leave, terminations, promotions, or pay. The opinion was in regard to Hamilton v. Dallas County, a lawsuit filed by female detention officers challenging a Dallas County policy that only allows male officers to have full weekends off.
Ms. Wheeler, who authored an amicus brief for multiple organizations in support of the female officers, praised the court’s decision and called the “reasoning of the decision … exactly what we hoped for.”
