Katz Banks Kumin partner Debra Katz authored an article for the December issue of ALI-CLE’s The Practical Lawyer titled, “Emerging Issues in Whistleblower Law and Retaliation.”
The work force has exploded over the last few decades, and with it, actions that are protected by whistleblower statutes at both the state and federal levels. Ms. Katz’s article covers crucial legislation – notably the Dodd-Frank Act and the Sarbanes-Oxley Act – and defines related terms such as “covered employees,” “protected activity,” and “causation.”
Much of the article applies specifically to the representation of executive level whistleblowers, and the unique situation that these employees are in compared to other employees. Executives within an organization typically have access to confidential corporate information, perform specific duties and responsibilities to the company, and have higher stakes in the settlement process.
