Debra Katz Discusses the Lawsuits Roger Ailes Left Behind

Katz Banks Kumin partner Debra Katz was quoted in a New York Magazine article entitled, "What Will Happen to the Sexual Harassment Lawsuits Against Roger Ailes?" In the article, author Lisa Ryan discusses what the outcome of the ongoing sexual harassment suits against the former Fox News chairman will be in the wake of his death. Ailes resigned from the network he co-founded last year in response to mounting sexual harassment claims, including a very public claim from former Fox News host Gretchen Carlson, which settled for $20 million. Two outstanding lawsuits remain - one from former Fox News host Andrea Tantaros, and another from an on-air contributor at the network, Julie Roginsky.

Commenting on the future of these cases, Ms. Katz noted that the lawsuits will continue to move forward. "The estate will be responsible for any kind of liability that ensues," she said. "There's now nobody to take the stand and to refute these allegations under oath, so I think Fox and Ailes's estate will have significant incentive to get them resolved." She added in a separate Washington Post article, "I think it absolutely will push them closer to settlement, both because it will be legally virtually impossible to defend against these allegations, but it also gives them a little bit of a narrative about why they’d be settling now,” she said. "I think it gives Fox a perfect out now to say, we continue to believe in the merits of our defense but as a practical matter we can’t defend with the central figure no longer alive."
