Lisa Banks and Michael Filoromo Speak at ABA Employment Conference

Katz Banks Kumin partners Lisa Banks and Michael Filoromo spoke at the ABA’s 13th Annual Section of Labor and Employment Law Conference. The meeting is among the largest of its kind and draws attorneys who represent employees, employers, and unions, as well as government attorneys, in-house counsel, and academics.  The program includes educational sessions that address timely topics  in the field of employment law, and is an opportunity for practitioners to meet and discuss their differing perspectives on evolving issues.

Ms. Banks spoke on the panel, “Trying the Challenging Employment Case,” about strategies for navigating complicated issues in a sexual harassment case.  Ms. Banks discussed how to address a plaintiff’s delayed reporting of harassment, the challenges associated with a “serial plaintiff” or “equal opportunity offender,” and different legal theories and approaches specific to #MeToo litigation.

Mr. Filoromo spoke on the panel, “Ethical and Strategic Issues When the Whistleblower is a Gatekeeper,” about the serious ethical considerations that arise when the whistleblower is a “gatekeeper,” – such as an attorney, accountant, or compliance officer.  These individuals are inherently positioned to learn of corporate misconduct, but most of them are subject to heightened ethical and confidentiality obligations. Mr. Filoromo spoke about strategies for representing such employees, while obeying the applicable ethical and legal obligations of the client and his or her counsel.
