KBK Attorneys Join NELA Conference in Philadelphia

Five KBK attorneys will join panels at the National Employment Lawyers Association Annual Convention in Philadelphia this week.

On Thursday, June 27, 2024 – 11:15 a.m.–12:15 p.m, KBK Partner Carolyn Wheeler will speak in a session titled “The State of the ADAAA.” In this session, she will join other NELA members and attorneys from the EEOC to explore how courts have applied the Americans with Disabilities Act Amendments Act of 2008 (ADAAA) under Title I of the Americans with Disabilities Act (ADA).

At the same time, Associate Sarah Nesbitt will speak in a separate session, “Trauma Informed Lawyering”, which will focus on strategies for effective communication with clients who have experienced trauma because of workplace discrimination, harassment, assault, or other unlawful actions. This panel will also focus on strategies to minimize the impact of secondary trauma to attorneys’ own mental health.

On Friday, June 28, KBK Attorneys will participate in three concurrent sessions from 12:30-1:30pm. Partner Mike Filoromo will speak in a session titled, “Developing a Successful Client Relationship”. This practical session will help attendees develop strategies to engage with their clients in a meaningful way by avoiding common mistakes in client communication, creating a relationship of trust and open communication.

Partner Rebecca Peterson-Fisher will speak on a panel titled “In the Wake of Morgan v Sundance: Forced Arbitration 2023-2024 Update”. This panel will address the most recent developments and case law in the word of arbitration following the 2022 ruling in Morgan v Sundance. In this case, the Supreme Court held unanimously that arbitration agreements are on the same footing as other contracts. As a result, many forced arbitration cases have been moving through the courts since the decision, addressing important issues like severability and what classes of workers are exempt from the Federal Arbitration Act.

Finally, Partner Avi Kumin will moderate a panel: “Considerations in Representing Executives”, which will focus on issues that arise when representing c-suite and other executive employees, covering matters such as contract negotiations to benefits agreements and severance packages.
