Matthew LaGarde, Lisa J. Banks, and Catherine Seita Publish Fourth Edition of Cybersecurity and Data Privacy Whistleblower Protections Guide
Katz Banks Kumin partners Matthew LaGarde and Lisa J. Banks and associate Catherine Seita published the Fourth Edition of the firm’s Cybersecurity and Data Privacy Whistleblower Protections Guide. The comprehensive guide describes the legal claims available to employees who report cybersecurity and data privacy issues, outlines the federal whistleblower rewards programs that may apply to them, and offers practical advice on how to blow the whistle in a responsible and protected way.
“The cybersecurity and data privacy regulatory landscape has shifted dramatically since our last edition,” said Mr. LaGarde. “This includes new SEC rules, a finalized CMMC framework, new whistleblower reward programs, and a steady stream of cyber-fraud enforcement actions. Whistleblowers who report these issues internally and externally are critical to keeping us all safe from cyber threats, and we wrote this guide to provide those individuals with a better understanding of their rights and protections.”
The Fourth Edition offers updated analysis of the laws and decisions that have changed the legal landscape since the last edition. Notably, the guide discusses the SEC’s 2023 Cybersecurity Rules and the creation of its Cyber and Emerging Technologies Unit; the Department of Defense’s finalized Cybersecurity Maturity Model Certification framework and the start of its phased rollout; FinCEN’s long-awaited steps to implement the Anti-Money Laundering Act whistleblower reward program; and new enforcement actions and case law involving cybersecurity violations and cybersecurity whistleblowers.
